No content, communication, profile, message, post, comment, chat exchange, article, user interaction, administrator communication, founder statement, or site feature shall be interpreted as creating a doctor-patient relationship, therapist-client relationship, counselor-client relationship, fiduciary relationship, privileged relationship, professional treatment relationship, or confidential clinical relationship. 4. No Emergency Monitoring or Duty to Act
PsychologyClub.com is not designed, staffed, monitored, or intended for emergency communication, crisis intervention, suicide prevention, violence prevention, abuse reporting, mandated reporting, medical response, psychiatric response, law-enforcement response, or urgent safety review. PsychologyClub.com does not guarantee that any message, post, report, chat, communication, or request will be reviewed, answered, escalated, investigated, retained, or acted upon within any particular time frame. The site may be unavailable, delayed, interrupted, unmonitored, or technically impaired at any time. Users agree that PsychologyClub.com, Dot Coms, Inc., the founder, administrators, moderators, operators, affiliates, contractors, service providers, and representatives have no duty to monitor user activity, detect emergencies, intervene in user conduct, verify user statements, provide crisis assistance, or prevent harm arising from user behavior or third-party conduct. You agree that PsychologyClub.com shall not be used as a means of obtaining emergency help, professional intervention, protective action, safety monitoring, or urgent review.
5. Membership Is a Privilege, Not a Right
PsychologyClub.com is a private online community. Membership, registration, access, posting, messaging, chat participation, profile visibility, and continued use of the site are privileges, not rights. No person has an entitlement to join, remain on, post on, communicate through, or access any part of PsychologyClub.com. PsychologyClub.com reserves the right, in its sole discretion, to refuse registration, deny access, restrict access, suspend accounts, terminate accounts, remove content, disable features, limit communications, block IP addresses, reject usernames, moderate posts, remove photos, disable profiles, or take any other action deemed appropriate. You must promptly report suspected unauthorized account use through
Client Assistance.
7. User Conduct and Community Standards
You agree to use PsychologyClub.com in a lawful, respectful, non-abusive, non-exploitative, and community-appropriate manner. You are solely responsible for your conduct and for all content you submit, post, upload, transmit, message, link, display, or otherwise make available through the site. 8. Adult Content Strictly Prohibited

PsychologyClub.com may remove or restrict allegedly infringing content and may suspend or terminate users who repeatedly violate intellectual-property or other rights. PsychologyClub.com may request additional information before taking action and may decline to act on incomplete, unclear, abusive, fraudulent, or unsupported requests. Submission of a complaint does not guarantee removal of content or any particular response. Users who submit false, misleading, abusive, or bad-faith complaints may have their access restricted or terminated.
17. Disclaimer of Warranties
PSYCHOLOGYCLUB.COM IS PROVIDED ON AN “AS IS,” “AS AVAILABLE,” AND “WITH ALL FAULTS” BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, PSYCHOLOGYCLUB.COM, DOT COMS, INC., AND THEIR FOUNDERS, ADMINISTRATORS, MODERATORS, OPERATORS, REPRESENTATIVES, AFFILIATES, CONTRACTORS, SERVICE PROVIDERS, SUCCESSORS, AND ASSIGNS DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. 18. Limitation of Liability

THIS LIMITATION INCLUDES DAMAGES FOR LOST PROFITS, LOST DATA, LOSS OF GOODWILL, EMOTIONAL DISTRESS, PERSONAL INJURY, REPUTATIONAL HARM, SERVICE INTERRUPTION, COMPUTER DAMAGE, SECURITY INCIDENTS, USER CONDUCT, THIRD-PARTY CONTENT, RELIANCE ON INFORMATION, ACCOUNT RESTRICTIONS, MODERATION DECISIONS, TECHNICAL ERRORS, OR INABILITY TO USE THE SITE. TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF PSYCHOLOGYCLUB.COM, DOT COMS, INC., AND THEIR FOUNDERS, ADMINISTRATORS, MODERATORS, OPERATORS, REPRESENTATIVES, AFFILIATES, CONTRACTORS, SERVICE PROVIDERS, SUCCESSORS, AND ASSIGNS FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATED TO THE SITE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100.00). These limitations apply regardless of whether the claim is based on contract, tort, negligence, strict liability, statute, equity, warranty, or any other legal theory. These limitations apply even if PsychologyClub.com or any related party has been advised of the possibility of such damages.
19. Release
To the fullest extent permitted by law, you release PsychologyClub.com, Dot Coms, Inc., and their founders, administrators, moderators, operators, representatives, affiliates, contractors, service providers, successors, and assigns from any and all claims, demands, damages, liabilities, losses, costs, and expenses arising from or related to user content, user conduct, third-party content, third-party websites, account disputes, moderation decisions, access restrictions, site errors, reliance on content, or interactions with other users. This release applies to known and unknown claims, suspected and unsuspected claims, disclosed and undisclosed claims, and claims that may arise in the future from your use of or relationship with the site. If you are a California resident, you waive California Civil Code Section 1542 to the fullest extent permitted by law, which provides that a general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in their favor at the time of executing the release and that, if known, would have materially affected the settlement with the debtor or released party. You understand that this release is intended to be interpreted broadly to protect PsychologyClub.com and related parties to the fullest lawful extent.
20. Indemnification
You agree to defend, indemnify, and hold harmless PsychologyClub.com, Dot Coms, Inc., and their founders, administrators, moderators, operators, representatives, affiliates, contractors, service providers, successors, and assigns from and against any claims, demands, actions, liabilities, damages, losses, judgments, settlements, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to your use or misuse of the site. This indemnification obligation includes claims arising from your content, posts, messages, uploads, profile information, communications, conduct, violation of these Terms, violation of law, infringement of rights, false statements, misleading conduct, inappropriate activity, unauthorized access, interaction with another user, or any harm allegedly caused by you. PsychologyClub.com reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification, and you agree to cooperate fully with such defense. Your indemnification obligations survive account termination, content removal, suspension, and discontinuation of site use.
21. Dispute Resolution, Arbitration, Class Action Waiver, and Jury Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS. To the fullest extent permitted by law, any dispute, claim, controversy, or cause of action arising out of or relating to PsychologyClub.com, these Terms, your account, your content, site access, site use, moderation, suspension, termination, privacy, communications, or any relationship between you and PsychologyClub.com or Dot Coms, Inc. shall be resolved by binding individual arbitration rather than in court, except where applicable law requires otherwise. You agree that any dispute shall be handled only on an individual basis. You waive the right to bring, join, participate in, or recover through any class action, collective action, representative action, private attorney general action, consolidated action, or mass arbitration to the fullest extent permitted by law. You knowingly and voluntarily waive any right to a jury trial to the fullest extent permitted by law. Before initiating any arbitration or legal proceeding, you must first contact
Client Assistance and provide a written description of the dispute, the facts supporting it, and the relief requested. The parties shall have thirty (30) days to attempt informal resolution. If any portion of this section is found unenforceable, the remaining provisions shall continue to apply to the fullest extent permitted by law.
22. Governing Law, Venue, and Time Limit for Claims
These Terms and any dispute arising out of or related to PsychologyClub.com shall be governed by the laws of the State of California, without regard to conflict-of-law principles. To the extent any claim is not subject to arbitration, or if arbitration is unavailable or unenforceable for a particular claim, such claim shall be brought exclusively in the appropriate state or federal courts located in California, unless applicable law requires otherwise. You consent to personal jurisdiction in such courts and waive objections based on inconvenient forum, venue, or lack of jurisdiction to the fullest extent permitted by law. To the fullest extent permitted by law, any claim or cause of action arising out of or related to PsychologyClub.com, these Terms, your account, your content, or your use of the site must be brought within one (1) year after the claim accrues, or it is permanently barred. This time limitation is intended to apply broadly to all claims that may legally be shortened by agreement.
23. Termination and Survival
PsychologyClub.com may suspend, restrict, terminate, or delete any account or access at any time. You may stop using the site at any time. Termination does not require PsychologyClub.com to delete records, logs, backups, moderation files, administrative notes, legal records, security records, or content retained for operational, evidentiary, legal, compliance, or security purposes. Termination does not affect provisions that by their nature should survive, including ownership, user-content license, disclaimers, limitation of liability, release, indemnification, arbitration, class-action waiver, governing law, venue, time limits, and dispute provisions. You remain responsible for conduct, content, and obligations arising before termination.
24. No Waiver, Severability, Assignment, and Entire Agreement
Failure by PsychologyClub.com or Dot Coms, Inc. to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision. If any provision of these Terms is found invalid, unlawful, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, and the remaining provisions shall remain in full force and effect. You may not assign or transfer your rights or obligations under these Terms without written permission. PsychologyClub.com and Dot Coms, Inc. may assign or transfer these Terms, the site, accounts, content, rights, obligations, or operations in connection with restructuring, transfer, merger, acquisition, sale, organizational change, or continuation of services. These Terms, together with any posted Privacy Policy, Cookie Policy, community rules, notices, and site policies, constitute the entire agreement between you and PsychologyClub.com regarding use of the site and supersede all prior or contemporaneous understandings regarding the same subject matter.
25. Final User Acknowledgment
By using PsychologyClub.com, you acknowledge and agree that PsychologyClub.com is a non-profit initiative of
Dot Coms, Inc.; that the site was founded by a Doctor of Clinical Psychology; that the site is not a therapy, counseling, clinical, medical, legal, crisis, or emergency service; that no doctor-patient, therapist-client, counselor-client, fiduciary, privileged, or professional relationship is created; that you use the site at your own risk; that membership is a privilege, not a right; and that you are bound by the disclaimers, limitations of liability, release, indemnification, arbitration, class-action waiver, governing-law, venue, and time-limit provisions stated above.
